Welcome to LastWordsFromMe. Please read these terms carefully before using our service.
1. What This Service Does
LastWordsFromMe is a message delivery service that allows you to write messages for your loved ones that will be delivered after a period of inactivity. You set a "check-in" schedule; if you do not check in via our App or Website within your chosen timeframe, your messages will be sent to your designated recipients.
2. Who Can Use This Service
You must be at least 13 years old to create an account. If you are under 18, we recommend using this service only with the guidance of a parent or guardian.
3. Your Account & Responsibilities
- Accuracy: You must provide accurate information when signing up.
- Security: You are responsible for keeping your password secure and notifying us of unauthorized access.
- Maintenance: You are responsible for checking in regularly and ensuring recipient email addresses are current. We are not responsible for delivery failures caused by outdated contact information.
4. Subscription Plans and Payments
We offer various plans (Free Trial, Land, Ocean, and Sky) with different limits on contacts and message frequency.
- Pricing: The specific fees, features, and limits for each plan are as stated on our official product webpage or the App Store/Google Play listing at the time of purchase.
- Automatic Renewal: Subscriptions renew automatically unless cancelled. You can cancel anytime through your account settings or platform subscription manager.
- Changes: We reserve the right to change our pricing. Price changes will not affect your current active subscription period but will apply to renewals.
5. Your Messages and Content
You own your content. However, you may not include:
- Threats, harassment, or hate speech.
- Content promoting illegal activities.
- Spam or commercial solicitations.
We do not read your messages as they are encrypted. However, we may suspend accounts if we receive valid complaints regarding harmful content.
6. Message Delivery Disclaimer
We make every reasonable effort to deliver your messages using reliable email services, but we cannot guarantee 100% delivery.
Delivery may fail due to:
- Incorrect/outdated recipient emails.
- Recipient email providers blocking our messages (spam filters).
- Technical issues beyond our control or expired subscriptions.
7. Data Retention & Privacy (PDPA)
- Compliance: We handle all personal data in accordance with the Singapore Personal Data Protection Act (PDPA).
- Active Subscriptions: Data is stored securely and encrypted.
- Expired Subscriptions: Account and message data are kept for 1 year after subscription expiry to allow for reactivation, after which they are permanently deleted.
- Logs: Activity logs are deleted after 90 days.
8. Refunds, Cancellations, and Plan Changes
- No Refunds: We do not offer refunds or prorated credits for any subscription purchases.
- Upgrades: When you upgrade, you are charged the prorated difference for the remainder of your cycle.
- App Stores: For purchases made via Apple or Google, refund requests must be submitted directly to those platforms. We cannot process these refunds ourselves.
9. Limitation of Liability
To the maximum extent permitted by Singapore law, our total liability is limited to the amount you paid us for your subscription in the 12 months prior to the event. We are not liable for:
- Emotional distress or mental anguish.
- Service interruptions or delivery failures.
- Legal disputes arising from the content of your messages.
10. Termination
You Can Leave Anytime
- Cancel your subscription through your account settings
- Request account deletion by contacting us
- Your data will be handled according to our Data Retention policy
We May Terminate Your Account If
- You violate these terms
- You use the service for illegal purposes
- You harass our staff or other users
- Your account is unsubscribed for more than 6 months
11. Dispute Resolution
If you have a problem, please contact us at akaidencomms@gmail.com. We will try to resolve it informally first.
If we cannot resolve the issue informally, any dispute will be settled through binding arbitration in Singapore.
12. Governing Law
These terms are governed by the laws of Singapore. Any legal proceedings will take place in Singapore.
